    The counsel for the complainant states that he had filed an application for withdrawal of previous complaint No.4105 of 2019 and proof of filing of the said application is not readily available and shall be filing today itself,  the said application is not traceable in the registry record also.                Further,  counsel for the respondent states that as per directions of the authority vide order dated 14.10.2022, respondent was supposed to offer an alternate plot within next 2 weeks  and the said offer was made to the complainant within the prescribed time but the complainant refused to accept the alternate plot at that time.                However,  the counsel for the complainant is filing an application today i.e. on 15.02.2023  that too accept the alternate plot alongwith late delivery charges i.e. DPC @ 10.6% for the applicable tenure  and refund of preferential location charges which they had paid to DLF Utilities Ltd and refund for the difference in size.                 The counsel for the respondent states that  while ordering to offer an alternate plot,  no mention was made by the authority regarding the delayed possession charges, hence,    delay possession charges request is denied  and further states that the complainant has never sought relief   of alternate plot in the two complaints of the said unit. However,  it was a gesture of the respondent to accommodate the allottee  which was not acceptable to the allottee and was not accepted by the allottee and now the respondent is ready to refund the entire amount alongwith interest as per the prayer of the allottee  in its original complaint.               Both the counsels of the parties  also request for a short adjournment of 2 weeks as they are willing to settle down the matter mutually.               Matter to come up on 09.03.2023 for further proceedings.

    This complaint and the complaint at serial 115  bearing CR No.751/2022 are of the same allottee and the same unit and hence clubbed together. Although the counsel of the respondent clarifies that the relief sought in both the complaints are different but may be heard together. The counsel for the respondent states that the plot allotted is not available at site due to PWD road and site of the instant plot got infringed at the time of demarcation and development works  at the site. Although the part CC after executing the development works in respect of above colony stands obtained on 02.07.2014 and subsequently for additional area  on 18.03.2016  but the offer of possession for the above plot which is not available at site, could not be made till date.  The respondent is offering alternate plot and shall submit the proposal duly marked on the copy of plan alongwith the area available at site within next two weeks in the registry of authority after supplying a copy of the same to the counsel of the respondent. Matter to come up on 22.12.2022 for further proceedings.
