RANDHIR KAPOOR AND ANR vs ATHENA INFRASTRUCTURE LTD

As per learned counsel for JD that matter has already been settled between the parties.  A copy of letter dated 04.09.2024 has been put on file. None is appearing for DH/complainant. To come at 2:00 p.m today in wait of DH.                                                                                                            2:25 p.m                      None is present on behalf of DH despite calling the matter several times since morning. It appears that DH is not interested in further prosecution of the matter.  Execution petition stands dismissed in default.                       File be consigned to Records.

None for JD, no objection are filed .                           This is a petition seeking execution of order passed by the Authority, in favour of DH/complainant. The authority through an order/resolution dated on 16.03.2022 delegated its powers to this forum to execute its orders. As per judgment of Hon’ble High Court of Punjab & Haryana, Chandigarh, in case tilted as M/s International Land Developers Pvt. Ltd. Vs. Aditi Chauhan and others CWP No. 7738 of 2022, and M/s International Land Developers Pvt. Ltd. Vs. Nitin Mathur and others CWP 7750 of 2022 for recovery of amount, recovery certificate is required to be issued to the collector concerned. let file be sent back to the authority with a request to issue recovery certificate/further orders.                          Parties to appear before the C.A of the Authority for preparing recovery certificate on 13.04.2023.

Learned counsel for JD requests for adjournment to file objections against decree/calculation made by DH stating that although this execution petition was revived on previous date, but He has no knowledge about that order. Request is not opposed. Allowed. Objections (if any) be filed till next date with an advance copy to the DH.                           To come on 09.03.2023 for further proceedings.
