DEEPAK CHOUDHARY AND SUNIL VISWANATHAN AND VINDHYA VASINI BATTULA vs VSR INFRATECH PRIVATE LIMITED

A settlement agreement was reached between the parties. It is submitted by learned counsel for DH that terms of said settlement are not adhered by the JD. Some cheques issued by same have been dishonored.                           Six cheques (PDC) total amounting Rs. 22,86,522/- are handed over to learned counsel for DH, today. Last date PDC is dated 31.03.2023. Adjournment is requested after this date. Allowed.                          To come on 13.04.2023 for further proceedings.

It is submitted by learned counsels for parties that matter has been settled between the parties.  Copy of settlement is already placed on record.                           Learned counsel for DH submits that last  instalment is due on 28.02.2023.  Matter be adjourned after that date.                          To come on 06.03.2023 for further proceedings.

It is submitted by both of counsels  that their clients are nearing settlement. Six cheques of Rs.6,01,847/-(total) are   handed over to counsel for DH today as part payment. Copies of which are placed on record.  Adjournment is requested for payment of  remaining amount. Not opposed. Allowed.                         To come on 29.07.2022 for further proceedings.

Learned counsel for JD submitted that parties have reached  a settlement.  While as per  learned counsel for DH,  no such settlement  has been reached between the parties. Although, it is admitted that three cheques of Rs.2,00,000/- each  have already been received  and got encashed by the DH.                      As per fresh calculations submitted by DH, a sum of Rs.6667025,38p.( as on  31.03.2022)  is  due against JD. Learned counsel for DH requests to call directors of JD  in person for their oral examination  or to disclose  properties of JD to be attached. Request is allowed. Let  JD be directed to give particulars of its assets/properties, including details of bank account(s) . Same be filed in the form of an affidavit, to be sworn by any one of the directors preferably by   the managing director, till next date. Copies of title deeds as well as statement of bank account(s)  be also filed alongwith affidavit.                       To come on 12.05.2022 for further proceedings.

Both of ld  counsels  submit that parties have reached  a settlement. Counsel for JD has handed over three cheques No.112710, 112711 and 112712 drawn on HDFC Bank, Gurgaon Sec. 14 Branch  all dated  30.03.2022 for Rs.2,00,000/- each to counsel for DH, out of total decretal amount of Rs.71,11,510/-  stated to have calculated till 31.12.2021.  Both of counsels request for some more time to give their respective calculations for remaining amount. Allowed.                            To come on 12.04.2022 for further proceedings.
