As per the orders of authority passed on 07.09.2021, the execution petition was disposed of and both the parties were directed to amicably settle the matter. On 06.12.2021, an application has moved on behalf of DH for restoration of the matter on the ground of non-compliance of the order by the JD, stating that he has already taken possession of the unit and cleared all the dues except stamp duty and registration charges. The counsel for the DH has contended that although the possession of the allotted unit has been taken over by the DH but the JD has not yet paid the decretal amount. The counsel for the JD submits that as per calculations of the promoter-JD, the decretal amount has been adjusted towards the outstanding dues of the DH and requests for referring the matter to the CA of the Authority for finalization of the calculation. Both the parties are directed to appear before the CA of the Authority on 25.03.2022 for verification of the decretal amount and the CA will submit his report within a week with a copy to both the parties. Matter to come upon 29.04.2022 for further proceedings.
