JD was directed to disclose its assets/properties including bank account till today by filing an affidavit to be sworn by anyone from its directors.   No such affidavit is filed.                         As per order XXI Rule 41 (3) CPC for disobedience in such a manner, JD/directors of JD can be detained to civil prison for a period not exceeding three months.           As requested by DH, issue arrest warrants against directors of JD  to be executable by bailiff till next date. Directors of JD be taken into custody and be produced before this forum on or before next date.  Detail of  said directors is already given.                         To come on 03.04.2025 for further proceedings.

It is pointed out that one of allottees/DHs namely Sh. Amrinder Singh, has expired. Learned counsel for DH requests for adjournment to file application to implead LRs of said deceased. Allowed.                             To come on 06.04.2023 for further proceedings.

Show cause notices were ordered to be issued to the directors of JD, as why same be not committed to civil imprisonment for not complying with order of this forum.                             Learned counsel for JD, requests for six months’ time to make  payment by selling some properties owned by sisters concern of JD.                            During deliberations, it is agreed that matter be adjourned after three months to see as what efforts are being made by JD to procure the amount by selling property (if any).                           To come on 06.03.2023 for further proceedings.

At the outset, it is pointed by learned counsel for DH that unit in question was allotted  in the name of Amrinder Singh and Raghubir Singh and Shri Amrinder Singh has already expired. She requests that entire decretal amount be paid to the co-allottee i.e. Raghubir Singh. Learned counsel is advised to approach the JD to give similar information.                                                    On previous date i.e. 09.05.2022, JD was directed  to give particulars of its asset/properties including details of bank account(s). Same were to be furnished in the form of an affidavit to be sworn by any one from directors preferably by managing director. No such affidavit is  filed despite service  upon S/Shri Arvind Walia, Balwant Chaudhry Singh, Sandeep Yadav, stated to be directors of JD. Learned counsel for DH requests to issue arrest warrants against said directors of JD.                       Issue show cause notice  to directors of JD as why they be not committed to civil imprisonment for not complying with orders of this forum. Reply, if any, be filed till next date.                       To come on 06.12.2022 for further proceedings.

Vide order dated 24.03.2022 of the Authority, directors of JD were  ordered  to be called for oral examination, with regard to assets/properties of JD. No report about service of notice.                   JD be directed again to give particulars of its assets/properties  including details of bank account(s) other than escrow account. Same be filed in the form of affidavit to be sworn by any from directors preferably by the managing director.
