On last date of hearing dated 23.05.2023, complainant requested to file rejoinder but the same was not done till date. Also, respondent no. 1,2 and 3 were directed to file reply but till date no reply has been filed by the respondents. Proxy counsel for the complainant requests for a short adjournment as the main counsel is not available today to argue the matter and further states that reply from respondent no.1 to 3 is not yet received by them. Proxy counsel for respondent no.3 states that he is fully aware of the facts of the case and requests for a short adjournment . On the last date of hearing following directions were issued under section 36 of the Act. 1. Respondent number 4 that is Bank of Baroda is restrained from proceeding with the e-auctions dated 24.01.2023 without considering and settling the claims of individual allottees. 2. Forensic audit of the accounts of respondent number 3 that is CHD developers be get done to bring out clear picture of the utilization/diversion of funds of investment funds with regard to the project if any Planning branch was also directed to initiate suo moto proceedings against the developers for non-registration of the above project under Section 3 and 4 of the RERA Act. The counsel for the respondent No.4 has supplied a copy of reply to the counsel for the complainant during proceedings and is filing the same in the registry of the authority within one week. The counsel for the complainant requests for filing rejoinder. He is directed to file rejoinder within next one week with an advance copy to the respondent No.4. The reply from respondent Nos.1,2 and 3 has not been filed so far. They are directed to file the same within 2 weeks with an advance copy to the complainant. Matter to come up on 10.10.2023 for further proceedings.
