SANGAM TRIPATHY AND SADHANA TRIPATHY vs RAMPRASTHA PROMOTERS AND DEVELOPERS LIMITED

On previous date, warrants  of arrest were ordered to be issued against directors of JD namely Arvind Walia and Balwant Singh Chaudhary to be executable by the bailiff of the authority till  today.                         None of them is arrested. I have perused the report given by the bailiff.  According to him, when he went to arrest the directors of JD but he was not allowed to enter inside the premises of said directors by the staff of JD/promoters. He requests for police assistance. It does not appear possible for the bailiff to arrest the directors of JD unless police assistance is provided. Request in this regard is allowed.                  Let fresh warrants of arrest against said directors of JD be issued to be executable by the bailiff of the authority for next date. Let DCP (HQ), Gurugram is asked to give police assistance to the bailiff to get directors of JD, arrested. Directors be taken into custody and be produced before this forum on or before next date.                         To come on 21.03.2025 for further proceedings.

As per Learned counsel for DH, he has already given fresh calculation of amount due.                       This is a petition seeking execution of order passed by the Authority, in favour of DH/complainant. As per judgment of Hon’ble High Court of Punjab & Haryana, Chandigarh, in case tilted as M/s International Land Developers Pvt. Ltd. Vs. Aditi Chauhan and others CWP No. 7738 of 2022, and M/s International Land Developers Pvt. Ltd. Vs. Nitin Mathur and others CWP 7750 of 2022 for recovery of amount, recovery certificate is required to be issued to the collector concerned.                        File be sent to CA for preparing recovery certificate. Parties to appear before CA on 06.04.2023.
