The present complaint has been filed on 15.10.2024 and registered as complaint no. 5059 of 2024. No reply has been received on behalf of the respondent till date. An application under Section 36 of the Act, 2016 has been filed by the complainants on 15.10.2024 seeking directions restraining the respondent from creating third party rights on the unit. The complainant booked a unit bearing no. N38D in the project “Smartworld Gems” situated at Sector-89, Gurugram on 16.01.2021. On 14.12.2023, the respondent cancelled the unit and refunded the entire amount to the complainant. The complainant has paid Rs.8,50,000/- against the total sale consideration of Rs.94,00,000/- till date. The counsel for the reply has handed over a copy of reply to the proxy counsel for the complainant during proceedings and shall file the same in the registry today itself. Matter to come up on 15.01.2025 for further proceedings.
