NORMA INDIA LTS THROUGH ITS DIRECTOR vs IREO VICTORY VALLEY

Due to administrative reason,  the matter is adjourned to 28.01.2025 for the purpose as already fixed.

The Authority issued notice to promoter restraining from registration of conveyance deed in the project namely, Ireo Victory valley situated in Sector-67 Gurugram on 07.06.2022.  The order dated 07.06.2022 was challenged before the appellate tribunal by M/s Indiabulls Commercial Credit Limited vide appeal no. 500 & 504 of 2020 and same were dismissed on 01.09.2022. Thereafter M/s Indiabulls Commercial Credit Limited filed an appeal before the Hon’ble High Court against the order dated 01.09.2022. The Hon’ble High Court dismissed the appeal and directed the authority to conclude its investigations/inquiry within a period of 6 months. Thereafter M/s Indiabulls Commercial Credit Limited approached this authority as per the directions of the Hon’ble High Court and the hearing is pending before this authority (Planning Branch). Further in the same matter it is also submitted that appeal no. 391 of 2022 Ireo Victory Valley Vs. Nidhi Singh and Appeal no. 428 of 2022 titled as Nidhi Singh Vs. Ireo Victory Valley are fixed for hearing before the Appellate Tribunal on 06.09.2024.  Therefore, in view of the above the matter is sub judice before the Hon’ble Tribunal as well as with the authority so no directions can be given regarding execution of conveyance deed.  Matter to come up on 26.11.2024 for further proceedings.

Matter be put up before the full bench on 03.09.2024 for further proceedings as there are vital issues to be considered.

Vide Resolution No.2116 dated 18.01.2024, District Bar Association, Gurugram has conveyed that due to sad demise  of  Shri Parveen Rao  Advocate, the  court work shall  remain suspended.  Matter is adjourned to 12.04.2024   for the purpose already fixed.

Matter to come up on 18.08.2023 for further proceedings.

The present complaint has been received on 21.12.2022. On the last date of hearing respondent appeared and was directed to file reply within 2 weeks. However, till date no reply has been filed in the authority. Counsel for the complainant states that they have not received the reply of the main complaint from both the respondents. Respondent no.2 is filing its response today and copy of the same has been handed over to the counsel for the complainant and shall be filing in the authority within three days. Proxy counsel appearing on behalf of the respondent  No.1 states at bar that they had filed an application on 27.1.2023 and requests that that application should be disposed off first.  However, reply of the main complaint shall be filed by them within one week with an advance copy to the counsel for the complainant. Counsel for the respondent states that there is an appeal pending in case of Nidhi Singh Versus Ireo Victory Velley  Pvt. Ltd.  in appeal No.428 of 2022  and  Ireo Victory Velley Pvt. Ltd. Versus Nidhi Singh in appeal no.391 of 2022. The counsel for the complainant states that the unit of the complainant is not covered under the unsold inventory as per the orders of the authority dated 20.7.2021 and further states that the present complaint has nothing to do with that and should be dealt separately. Part arguments heard. Both the parties are directed to file written submissions after supplying a copy to each other within a period of 15 days . Matter to come up for final arguments on 7.7.2023.

The authority is busy to attend interaction programme to be held on 16.03.2023 and 17.03.2023 at India International Centre New Delhi organized by AIFORERA, so, the matter is adjourned to 05.05.2023 for the purpose as already fixed.

The present complaint was filed on 21.12.2022 and registered as complaint no. 7794 of 2022. As per the registry, complainant has sent copy of complaint through speed post as well as through email and proof regarding having the delivery of the complaint made to the respondents was submitted by the complainant as available in the file. The registry of the authority also sent a notice along with a copy of the complaint through speed post. The tracking report shows that ‘item returned as addressee left without instructions’  Registry has also sent the notice along with a copy of the complaint through email at the following email address [email protected], [email protected], [email protected], [email protected] . The same is shown to have been delivered on the above email address as per the report available in the file. However, no reply has been received on behalf of the respondent till date. The respondent is directed to file reply within two weeks i.e., by 16.02.2022 in the registry with a copy to the complainant. Last opportunity is being granted. In case reply is not filed within the time allowed, the defense of the respondent may be struck off. Matter to come up on 17.03.2023  for further proceedings.
