The present complaint was received on 06.08.2024 and registered as complaint bearing no. 3587 of 2024. On 13.08.2024, the counsel for the complainant has filed an application u/s 36 of Act bearing no. MA No. 537 of 2024 and is seeking directions to restrain the respondent no.1 to create any third party right on the unit under question.   On last date of hearing (i.e., 12.09.2024), the complainant was directed to clarify the actual amount paid against the unit allotted and the respondent was given one more last opportunity to file the reply on application u/s 36 of the Act. The counsel for the complainant is filing the payment plan in the registry within one week. The counsel for the complainant states the respondent has unilaterally cancelled the unit on 21.02.2024. Further states that they had already paid an total amount of Rs.1,12,05,206/- to the respondent no.1 & 2 against two allotted units, out of which half of the amount (i.e., Rs.56,02,603/-) was being paid against the unit under question in the present complaint against total sale consideration of Rs.77,77,417/-. Further states that a similar matter  bearing CR no.3585/2024 is pending before the  bench  of Shri Ashok Sangwan, Hon’ble Member and is listed on 27.11.2024 and in that matter the Authority had already directed  the respondent to maintain status-quo on the unit of the complainant till next date of hearing and requested to restrain the respondent to create any third party rights and further requested for transferring the present matter to the same bench. In view of the above, the respondent is directed to maintain status quo on the unit of the complainant till the next date of hearing and the present matter is also  transferred to the bench  of Shri Ashok Sangwan, Hon’ble Member. Matter to come up on 27.11.2024 for further proceedings.

On 13.08.2024, the counsel for the complainant has filed an application u/s 36 of Act bearing no. MA No. 537 of 2024 and is seeking directions to restrain the respondent no.1 to create any third party right on the unit under question. The counsel for the complainant states that they had paid an amount of Rs.1,12,00,000/- (approx.) w.r.t. two unit in the same project and total sale consideration is Rs.77,77,418/- for each unit. The counsel for the complainant to clarify the actual amount paid by them w.r.t. the unit under question. One more opportunity to the respondents to file reply to the application. Matter to come upon 26.09.2024 for further proceedings.
