TARUN ANAND vs VATIKA LIMITED

The present complaint has been filed on 28.07.2022 and registered as complaint no. 5431 of 2022 and reply was received on 12.04.2023 and written submission on behalf of respondent on 01.08.2024.  Ms. Ankur Berry, new counsel for the respondent states that the matter has been settled between the parties and seeks a short adjournment for filing of settlement deed. The counsel for the complainant has already filed amended memo of parties along with the copy of the registered Will of the co-allottee Shri Krishan Lal Anand and POA on behalf of its legal heirs. A copy will be sent through mail to the new counsel within one week. Matter to come up on 07.11.2024 for further arguments.

The present complaint has been filed on 28.07.2022 and reply was received on 12.04.2023.  On 19.07.2023, the counsel for the respondent has objected that the title of the compliant is in the name of Tarun Anand where the unit in question was allotted to Shri Krishan Lal Anand, where the counsel for the complainant agrees to file necessary documents of succession within 2 weeks. Further on 02.11.2023, the counsel for respondent seeks four weeks’ time to file the legal heir’s certificate and amended memo of parties and request for adjournment. On 30.11.2023, the counsel for the complainant filed the copy of surviving member certificate. Surviving member certificate indicates that Shri. Krishan Lal Anand left three legal heirs behind him, where the complaint was filed by only one of the legal heirs of the deceased allottee.     The counsel for the complainant states that  there is a registered will in favour of the complainant Shri Tarun Anand  who is one of the legal heir of the deceased allottee as well as co-purchaser of the property.  The copy of registered will shall be filed within 6 weeks. Matter to come up on 08.08.2024 for further proceedings.

The present complaint has been filed on 28.07.2022 and reply was received on 12.04.2023.  Case has been called out but no one has appeared on behalf of the complainant.  One last and final opportunity is being granted to the complainant to appear and to pursue the matter. The counsel for the respondent objects to the title of the complaint as the unit in question was allotted to Shri Krishan Lal Anand and Tarun Anand while the complaint has been filed by Shri Tarun Anand son of the  deceased co-allottee.  The counsel for the complainant agrees to file necessary documents of succession within a period of 2 months with an advance copy to the respondent. Matter to come up on 02.11.2023 for further proceedings.

The counsel for the respondent requests for a short adjournment for filing of reply.  Respondent is directed to file reply within two weeks i.e., by 21.02.2023, with advance copy to the complainant subject to a cost of Rs 5,000/- to be paid to the complainant. Last opportunity is being granted. In case reply is not filed within the time allowed, the defense of the respondent may struck off.                      Matter to come up on 19.07.2023  for further proceedings.

Vide Resolution No. 639 dated 19.10.2022 District Bar Association Gurugram  intimated that today i.e. 19.10.2022  the work shall remain suspended due to Diwali Festival and in view of the call given by Bar Council of Punjab and Haryana to suspend work in protest of raids conducted by NIA in an illegal manner at the place of Advocates of Chandigarh, Gurugram and Bhatinda. Matter to come up on 07.02.2023 for further proceedings.
