    The respondent filed an application dated 06.10.2023 challenging the maintainability of the complaint on the ground that after receiving Occupation Certificate dated 24.02.2020, Offer of Possession and executing Conveyance Deed dated 25.03.2021 i.e., after almost 2 years of duly execution of Conveyance Deed, the present complaint is filed which is not maintainable in eyes of law. The complainant was directed to file the reply of application, however, the same has not been filed till date.  The counsel for the complainant states that the authority has already decided the cases in above project and hence does not wish to file separate reply to the above application for maintainability. Matter to come up on 20.02.2025 for arguments on the issue of maintainability.

The said request was allowed, and the respondent was directed to file the reply within 10 failing which the cost of Rs.5,000/- to be paid to the complainant.
