MRS REEPU AND SAHIL ARORA vs APEX BUILDWELL PVT. LTD.

The present complaint was received on 15.05.2023 and the reply on behalf of respondent was received on 06.10.2023. The respondent filed an application dated 06.10.2023 challenging the maintainability of the complaint on the ground that after receiving Occupation Certificate dated 24.02.2020, Offer of Possession and executing Conveyance Deed dated 25.03.2021 i.e., after almost 2 years of duly execution of Conveyance Deed, the present complaint is filed which is not maintainable in eyes of law. The counsel for the complainant to file response to the above application dated 6.10.2023 filed by the  respondent. The respondent is also  directed to file the date of commencement of construction to enable calculation of the due date as per possession clause within a period of 2 weeks with an advance copy to the complainant. Matter to come up on 25.07.2024 for further proceedings.

The present complaint was filed on 25.05.2023 and registered as complaint no. 2270 of 2023. On the last date of hearing Shri Harshit Batra Advocate, appeared on behalf of the respondent and filed power of attorney and requests for a sought short adjournment for filing of reply. The said request was allowed, and the respondent was directed to file the reply within 10 failing which the cost of Rs.5,000/- to be paid to the complainant. A reply in the matter has been filed by the respondent on 27.12.2023 with advance copy to the counsel for the complainant alongwith an application for waiver of cost.  In view of the fact that the reply has been filed after a lapse of more than seven months, there is no justification in waiver of cost. Matter to come up on 28.03.2024 for arguments.

The present complaint was filed on 25.05.2023 and registered as complaint no. 2270 of 2023. Shri Harshit Batra Advocate has appeared on behalf of the respondent and filed memo of appearance today. Written reply has not been filed by the respondent so far.  The counsel for the respondent requests for a short adjournment for filing of reply.  Respondents are directed to file reply within two weeks i.e., by 19.10.2023 in the registry with a copy to the complainant failing which cost of Rs.5000/- shall be imposed upon the respondent.  Last opportunity is being granted. In case reply is not filed within the time allowed, the defense of the respondent shall be struck-off. Matter to come up on 04.01.2024 for further proceedings.
