MD ASHRAF vs SAI AAINA FARMS PVT. LTD

The complainant is seeking the relief of physical possession as well as delay possession charges. None appeared on behalf of the respondent today. The proxy counsel for complainant submits that here in the present complaint they are seeking relief of DPC and the Authority has already adjourned sine die complainant against Sai Aaina Farms Private Limited wherein DPC is sought. So, in view of the present matter may also be adjourned sine die. The Authority observes the registration certificate granted by the Authority has already been revoked on 11.03.2024 and even license of the respondent promoter has been expired. Hence in view of the above, the matter is adjourned sine die. The complainant may file an application for revival of the present complaint as and when project is revived. File be consigned to the registry.

Since the Hon’ble Chairman/Members of the Authority are busy to attend the 2nd Annual Conference AIFORERA to be held from 16.07.2024 to 19.07.2024 at Kodaikanal (Tamil Nadu) hence,  the matter is adjourned to 12.09.2024 for the purpose already fixed.

The present complaint was filed on 14.07.2023 and registered as complaint no. 2971 of 2023. Despite proper service of notice, no written reply has yet been filed. Moreover, the service is also confirmed from the fact that on the last date of hearing, Shri Rahul Raghav Advocate, of the respondent company appeared and was directed to file the reply within two weeks, i.e., by 21.12.2023, in the registry with a copy to the complainant subject to payment of Rs.7000/- as cost to be paid to the complainant failing which the defence of the respondent shall be struck off.  Written reply has not been filed by the respondent so far. The counsel for the respondent requests for one week time for filing of reply. One more opportunity is being granted to respondent to  file the reply within two weeks i.e., by 28.03.2024 in the registry with a copy to the complainant along with additional cost of Rs. 5000/- if the reply is not filed  in the stipulated period. It is the last opportunity.  In case the reply is not filed within the time allowed, the defence of the respondent may be struck off. Matter to come up on 18.7.2024 for further proceedings.
