RAJIV DHAR vs SPAZE TOWERS PVT. LTD.

The counsel for the complainant has placed on record a copy of order dated 21.10.2024  passed by Hon’ble NCLT, Court – IV, New Delhi in case no. CP No. (IB)/284/2021 in the matter of  Vivek Khanna and others versus Spaze Towers Pvt. Ltd. vide which the petitions have been admitted by the Hon’ble NCLT and moratorium is initiated in terms of Section 14 of the IBC, 2016 and Shri Gaurav Katiyal has been appointed as IRP of the corporate debtor. In view of the above, the matter is adjourned sine-die till the outcome of the above proceedings before NCLT. The complainant may file an application for revival as and when the directions for lifting moratorium are issued by the Hon’ble NCLT. File be consigned to the registry.

The present complaint was filed on 08.04.2024 and registered as complaint no. 1380 of 2024. On the last date of hearing, Ms. Anshika counsel of the respondent filed a memo of appearance and was directed to file the reply by i.e., 02.08.2024 in the registry. However, no written reply has been filed by the respondent nor has the cost of Rs. 5000/- been paid to the complainant. The respondent is granted final opportunity to file the reply within two weeks i.e., by 20.09.2024 in the registry with an advance copy to the complainant along with an additional cost of Rs.7,000/- to be paid to the complainant. Last opportunity is being granted. In case the reply is not filed within the time allowed, the defence of the respondent shall struck off. Matter to come up on 20.12.2024 for further proceedings.
