    The present complaint was filed on 31.01.2023 and registered as complaint no. 350 of 2023 and the no reply has been received till date. Earlier, the respondent company was under moratorium as the CIRP proceedings were against the respondent company vide orders dated 31.08.2023 by the NCLT, New Delhi in Company petition IB (IBC) No. 525/2022 hence the matter was adjourned sine die. After setting aside the CIRP proceedings against the company by the NCLAT, the counsel for the complainant had moved an application for revival of complaint on 07.05.2024 which was allowed. On last date of hearing, the respondent was directed to file reply within 3 weeks. But till date no reply has been filed. However, an application was moved by the respondent on 07.01.2025 for waiver of cost of Rs.5,000/- imposed by the Authority vide hearing dated 19.09.2024. The respondent has filed reply only on 08.01.2025 while it was required to be filed within 3 weeks from 19.09.2024 and hence, there is no reason to waive off the cost. Hence the application is declined. The respondent shall pay the cost to the complainant before the next date of hearing.  The counsel for the respondent to supply a copy of reply to the counsel for the complainant today itself. Matter to come up on 17.04.2025 for further proceedings.

On hearing dated 10.11.2023, the proxy counsel for the respondent stated that the CIRP proceedings have been initiated against the respondent company vide orders dated 31.08.2023 by the NCLT, New Delhi in Company petition IB (IBC) No. 525/2022. Keeping in view the orders of Hon’ble NCLT the present complaint was adjourned sine die. Now, the CIRP proceedings against the company have been set aside by the Hon’ble NCLT, the counsel for the complainant has moved an application for revival of complaint on 07.05.2024. On last date of hearing, the request for revival of complaint was allowed. The respondent was directed to file reply within 3 weeks. But till date no reply has been filed. Reply has not been filed by the respondent till date. The counsel for the respondent requests for a short adjournment to file the same.  The respondent is directed to file reply within 3 weeks with an advance copy to the complainant failing which cost of Rs.5000/- shall be imposed upon the respondent.
