THE PRESENT COMPLAINT HAS BEEN RECEIVED ON 15.06.2023 AND REGISTERED AS 2421 OF 2023 AND REPLY WAS RECEIVED ON 30.11.2023. HENCE, THE COMPLAINT IS DISMISED IN DEFAULT FOR NON-APPEARANCE OF THE COMPLAINANT. FILE BE CONSIGNED TO THE REGISTRY.

The present complaint has been received on 15.06.2023 and registered as 2421 of 2023 and reply was received on 30.11.2023. The counsel for the respondent states that the unit has been cancelled and amount has been refunded to the complainant and no unit is available for allotment as cancellation has been affected after following the due process prescribed in the policy. Case has been called out but no one has appeared on behalf of the complainant today. One more opportunity is being granted to the complainant to appear and to argue the matter. Matter to come up on 12.12.2024 for further proceedings.

On last date of hearing, the counsel for both the parties stated that the settlement talks are in progress between the parties to settle the matter amicably and sought adjournment to file the settlement deed. But till date no settlement deed has been placed on file. The counsel for the respondent states that matter could not be settled amicably. However the son of complainant present  in person requests for an adjournment due to non availability of the arguing counsel. Request is allowed. Matter to come up on 05.09.2024 for further proceedings.
