The present complaint was filed on 16.02.2024 and reply was received on 30.05.2024. An application for dismissal of complaint was filed by the respondent on 11.09.2024. An application for counter claim was filed by respondent on 16.01.2025. The counsel for the complainant request for an adjournment to file a written reply to the counter claim submitted by respondent and to argue the matter. The counsel for the complainant to file response to the said application within 4 weeks with an advance copy to the respondent. Matter to come up on 23.01.2025 for further proceedings.

As per order dated 04.04.2024 respondent was allowed to file reply within three weeks of the order failing which with cost of Rs. 5,000/- to be paid to the complainant. Admittedly reply was not filed within stipulated period so respondent is supposed to file reply with cost of Rs. 5,000/-. Today reply filed by the respondent in the registry taken on record. Copy of same also supplied to the learned counsel for the complainant. Cost of Rs. 5,000/- not paid. Adjournment requested on behalf of respondent. Now the matter is listed before the Authority for 19.09.2024 for final arguments as well as payment of cost of Rs. 5,000/- by the respondent. It is made clear to the respondent that in case cost of Rs. 5,000/- not paid on behalf of the respondent to the complainant then reply filed by the respondent may not be read over by the Authority at the time of final disposal of the complaint.

Respondent is hereby directed to file reply within three weeks of this order, in the registry with advance copy to the complainant, failing which with cost of Rs. 5000/- to be paid to the complaint.
