    The present complaint was filed on 14.10.2022 and reply on behalf of the respondent was received on 28.12.2023, after delay of a year. However, the counsel for the respondent states that complaint is barred by limitation on the ground that  not only  offer of the possession was made in 2019 after obtaining OC on 29.11.2019 and CD has been executed on 11.12.2020.  The cause of action arose on the due date which was 02.06.2017 and hence, the complaint filed by the complainant in 2022 may not be entertained.     The present complaint was filed on 14.10.2022 and reply on behalf of the respondent was received on 28.12.2023, after delay of a year. On last date of hearing counsel for the complainant contended that the reply should not be read over as the respondent has been repeatedly instructed over the course of three preceding proceedings, to pay a sum of Rs. 10,000/- as costs for the tardy submission of the reply within the specified timeframe. However, the aforementioned amount still remains outstanding as of present date. The counsel for the respondent is willing to hand over the cheque of cost imposed by the authority and case has been called out but no one has appeared on behalf of the complainant today. One last and final opportunity is being granted to the complainant to appear and to argue the matter.     Meanwhile, the respondent is also required to clarify the date of commencement of construction to enable determining the due date of possession and the counsel assures to give the details within 2 weeks.
