The Present complaint was filed on 16.08.2023 and the reply on behalf of respondent was received on 14.12.2023. On 21.03.2024, the counsel for the respondent was directed to file the status of completion of the unit along with reasons for accepting of more 10% of sale consideration without entering into buyer’s agreement. On last date of hearing (i.e., 30.05.2024), the respondent was given one more and last opportunity for filing of written submissions along with clarification of status of unit within 3 weeks failing which it shall be presumed that the respondent has nothing to say and further proceedings may be initiated against the respondent. The proxy counsel for the respondent requests for a short adjournment as the arguing counsel is not available today due to health issue.  Request is allowed. The counsel for the complainant states that  despite having paid Rs. 50,56,625/- against a total consideration of Rs.68,25,000/-,  BBA is not yet executed and neither the assured return from November 2018 not paid.  The amount paid as well as consideration amount is duly admitted by the respondent  in para No.12 of the reply at page No.5. The respondent is not intimating the status of completion of the unit  for which the respondent is directed to file the status of completion of the unit alongwith  specific unit number and reasons for accepting more than 10% of consideration money without execution of BBA. Matter to come up on 30.05.2024 for further proceedings.

The present complaint was filed on 16.08.2023 and registered as complaint no. 3623 of 2023. The counsel for the respondent has handed over a copy of reply to the counsel for the complainant during proceedings and shall file the same in the registry within a period of one week. The respondents are directed to file reply within  one week  in the registry. Last opportunity is being granted. In case reply is not filed within the time allowed, the defense of the respondents shall be struck off. Matter to come up on 21.03.2024 for further proceedings.
