103/2023 Shobhabai Vrs.

Nil ORDER BELOW EXHBHIT 01.

This is an application for grant of legal heir-ship certificate as per Bombay Regulation Act.

02 The application reveals that applicant is the wife of the deceased husband Sanjay Pandit Patil who died on 04.11.2003.

Applicant has pleaded that she is in need of heirship certificate for mutating the property, Government and Semi government schemes therefore it appears that applicant is seeking formal declaration of heirship.

Hence, this application.

03 The proclamation was issued in daily newspaper “Gaonkari” dated 22.03.2023 Exh-14 calling objections from the public.

Despite its issuance, nobody appeared to resist the claim of applicant.

04 Applicant have filed affidavit of herself in lieu of examination-in-chief at Exh-09.

The evidence of applicant remained unchallenged.

Applicant have also filed on record the copy of death certificate of her husband vide Exh-10.

She also filed on record copy of her own Adhar card at Exh 11 and Adhar card copies of son and daughter at Exh.

12 and 13 respectively and closed her evidence by filing pursis vide Exh-15.

05 Thus, considering all above facts and documents filed on record, it appears that applicant and persons mentioned in para No.3 of the main application are the legal heirs of the deceased.

Moreover, the heir-ship certificate is merely a formal recognition that the applicant and persons mentioned in para No.3 are the legal heirs of the deceased.

Hence, this court has no hesitation to issue heir-ship certificate in favour of applicant.

Hence, the following order is passed.

ORDER 1.

Application is allowed.

2 2.

Issue heir-ship certificate in favour of applicant and her son and daughter showing them as legal heir of the deceased Sanjay Pandit Patil as per rules.
