Advocate of the accused person files a petition along with copy of an order of National Lok Adalat dated 09.03.2024 for compounding the offence, stating, inter­alia, that the case has been compounded with the authority (WBSEDCL) in accordance with the said order passed in National Lok Adalat.

Supportive documents have been filed.

Let the same be kept with the record.

Copy of the petition has been served upon Ld.

PP­in­charge.

Heard Ld.

Advocate for the accused person.

P.P.­in­charge who has not raised any objection.

Documents filed by the accused this day go to suggest that the case has been compounded in between the accused person and WBSEDCL on payment of compounding charges and the accused has already paid the compounding charges.

As per the provisions of Sec.

152 of Electricity Act, 2003 the alleged offence is compoundable in nature.

Thus, in view of the foregoing discussion, the accused person is entitled to an order of acquittal as per the provisions of u/s.

152(3) of Electricity Act.

Hence, it is ORDERED that the sole accused person namely, Sanat Saha is hereby acquitted from this case.

The instant petition is accordingly disposed of.

He is discharged from his bail bond at once.

Seized Alamats, if any, be confiscated to the State.

Accordingly, the case is disposed of.

Note in the relevant register and in the CIS accordingly.
