Heard on the application moved by applicant under Section 5 of Limitation Act for condonation of delay in filing the appeal.
As per averments made in the application, there is delay of three days.
Considering the facts and circumstances as averred in the application, this Court deems it appropriate to condone the delay in filing the appeal as no prejudice would be caused to the respondent in case the appeal is heard on merits of the case.
Moreover, it is cardinal principle of law that no one should be condemned unheard and hence, delay in filing the appeal, is, hereby, condoned subject to deposit of costs of Rs.500/- with the District Legal Services Authority, SBS Nagar.
