Through the currency of instant application, applicant seeks the indulgence of this Court seeking direction to non­applicants to register the birth particulars of the applicant in record on the ground that the same has not been registered with the non­applicants.

Application is supported by an affidavit.

Non­applicants filed a report mentioning therein that entry with regard to birth of applicant has not been effected in the relevant records.

Notice to general public regarding the instant application was issued and published in daily newspaper “Early Times” Jammu in its edition dated 30.08.2023, calling upon the general public to file objections, if any, to the issuance of birth certificate of the applicant.

However, none appeared in response to said publication to register any objection whatsoever.

Thereafter, applicant was directed to produce evidence in support of application.

Applicant filed evidence affidavits of himself along with witnesses namely Premi Devi W/o Purab Chand R/o Salal, Tehsil & District Reasi & Purab Chand S/o Shiv Ram R/o Salal, Tehsil & District Reasi which are made part of the file.

The evidence by way of affidavit of Kapoor Singh fully supported the contents of the application whereas evidence by way of affidavits of Premi Devi & Purab Chand fully supported the contents of application as well as the corroborated evidence of the applicant.

Now from the perusal of statements made on oath, it is established that applicant namely Kapoor Singh was born on 21.08. on 21.08.1966 at home by his mother namely Goga Devi and his father's name is Mir Chand.

As now it has been established without any doubt that applicant was born on 21.08.1966.

In such circumstances, non­applicants are therefore, directed to enter the birth particulars of applicant in the Register of Birth in terms of Section 13 (3) of the Registration of Birth and Death Act, 1975 as follows:­ Name of applicant Father Name Mother Name Date of Birth Place of Birth Sex Kapoor Singh Mir Chand Goga Devi 21.08.1966 At home Male 6.
