Friday, the 08 th day of September – 2023 The 17th day of Bhadra – 1945 (S.E) STC No.1136/2023 Complainant : State Represented by SI of Police, Thalapuzha Police Station in Crime No.440/23 (Rep. by Smt.Sukanya.P, APP, Gr.II) Accused : 1.

Shanoj Koova (42/23), S/o.Govindan, Koova (H), Madayitheru, Pazhayangadi Post, Kannur City.

Roopesh (31/23), S/o.Karunakaran, Koova (H), Madayitheru, Pazhayangadi Post, Kannur City.

Offence : under section 15(c) r/w 63 of Kerala Abkari Act.

Plea : 'Guilty' Finding : 'Guilty' Sentence or order : Both accused sentenced to pay fine of 1,000/- each ₹1,000/- each under section 15(c) r/w 63 of the Abkari Act.

In default of payment of fine, they shall suffer simple imprisonment for ten days.

J U D G M E N T This is a case instituted on a report by the Sub Inspector of Police, Thalapuzha PS in Crime No.440/23, alleging the offences punishable u/s 15(c) r/w 63 of Kerala Abkari Act.

Prosecution in brief are as follows: On 17.07.2023 at 18.00 hours, the accused were found consuming liquor in front of road margin, at a place called Boys Town in Periya amsom.

The accused were arrested and contraband seized by the police party.

Thus, the accused alleged to have committed the offence under section 15(c) r/w 63 of Kerala Abkari Act.

The Court took cognizance and summons were issued.

Both accused present.

The copies of relevant prosecution records were furnished to the defence counsel in compliance of section 207 of the Code of Criminal Procedure.

On going through the case records, summons were issued to the accused.

Copies of relevant prosecution records were given to them.

The allegation against the accused are that the accused were found consuming liquor in a public place.

Particulars of 2/2 STC. f 2/2 STC.1136/2023 offence under section 15(c) r/w 63 of Abkari Act read over and explained to the accused to which they pleaded guilty and same is accepted.

Hence, the accused are found guilty of the offence punishable under section 15(c) r/w 63 of Abkari Act.

Both accused are sentenced to pay fine of 1,000/- each ₹1,000/- each under section 15(c) r/ w 63 of the Abkari Act.
