The petitioner and respondent have filed joint memo.

In view of the joint memo filed by the parties, the petition under Section 13 (3) of Registration of Births and Deaths Act, 1969 is hereby allowed.

In the case of Devamma V/s Registrar, Births and Deaths Mysore reported in AIR 2004 KARNATAKA 221 the Hon'ble High Court has observed that, the correctness or other wise of the date of birth concerned is totally irrelevant in the proceedings under Section 13 (3) of Registration of Births and Deaths Act, 1969 and only the fact of birth is relevant.

Hence, the respondent is hereby directed to Nagaveni D/o Chandrashekhar R/o Hebbal Tq Kalagi, Dist.

Kalaburagi. in the concerned register as: 03-03-2014 after collecting the fee in that behalf.

This entry shall not be the conclusive proof regarding the date of birth of petitioner, if it is disputed in any criminal case or litigation.

It is further clarified that this order is only applicable to produce before the Respondent Office to enter the date of birth and it is not valid for any other purpose.
