The execution filed for the relief of enforcement of decree passed in O.S 265/2018 dated 31.08.2019. on careful perusal of cause title the JDR is residing at Mysore District.
As per sec 39(4)of CPC this court cannot executed the decree since, the JDR is residing out side the jurisdiction of this court.
Hence, it has to be transferred to the concerned court.
Accordingly this court proceed to pass the following, ORDER The decree in O.S 265/2018 dated 31.08.2019 is hereby transferred before the Hon'ble Prl.Civil Judge and JMFC, Mysuru.
Office is hereby directed to submit entire records before the Hon'ble court.
Accordingly this case is disposed of.
