Accused : Sri.
Banu Wilson Kumar S/o Yesumitra Age:43 years, Occ:Private work, R/o Tarfile, Kalaburagi Date : 09.08.2023 This case is taken up on today's Board.
Before going to issue summons to accused, herein he himself appeared before the court and he submitted that he is going to plead guilt the offence as stated in the charge sheet.
Therefore, on going through the case file on hand herein it is discloses that, so far as the alleged offence against the accused is concerned, punishable U/Sec.185 of IMV Act.
It contamplates that he had drow his motorcycle bearing No.
KA32/X8122 with consuming alcohol exceeding the quantity level of 30 mg per 100 ml of blood which detected in a test by a breath analyser shall be punishable with imprisonment of 6 months or with fine or both.
On considering the facts and circumstance and contents which mentioned in the charge sheet herein it is taken into note that, an enquriy of the accused he submits that, he is going to plead guilt the offence as stated in the charge sheet.
As to which after identifying him through court PC, by name Laxmikanth HC No.148 of Taffic PoliceI.
Thereafter, plea which prepared and same is read over in the Kannada Language as he well to the accused, after he understood and admitted the contents of the same.
While recording of the plea, this court found that the accused who present here voluntarily pleaded guilt.
Hence, I accept plea of the accused and proceeded to pass the following: ORDER Acting under Section 252 of Cr.P.C the accused is hereby convicted for the offence punishable under Sec.185 of M.V.Act.
Consequently, the accused is hereby sentenced to pay a fine of Rs.10,000/ for the offence punishable U/Sec.185 of M.V.Act, in default, he shall under go SI for 15 days.
Accordingly, this case is disposed off.
