PC No.108/2023 11.08.2023 Complainant presented the complaint.
I have perused the complaint and the documents annexed therewith.
It is alleged that the accused has issued banker’s cheque in favour of complainant which came to be dishonoured for reason – “FUNDS INSUFFICIENT”.
Notice was issued to accused on 04.07.2023 Notice was served on 06.07.2023, Accused has not made the payment under the returned unpaid cheque within 15 days.
Complaint is preferred within 30 days.
All the necessary requirements of Section 138 of NI Act are complied with.
Hence, prima facie commission of offence p/u/s 138 of NI Act is made out.
Cognizance of offence p/u/s 138 of NI Act, 1881, is taken.
Affidavit in lieu of Sworn Statement is filed.
Documents annexed are marked as Exhibits P1 to P8.
Hence, office is directed to register a criminal case against the accused.
Office is further directed to issue summons (annexed with a copy of complaint) to the accused by RPAD, if PF and cover is furnished by the complainant.
