Memo filed by the counsel for the complainant is taken for consideration.
In the memo, it is stated that the accused has paid the amount mentioned in the cheque as per the settlement arrived between the parties and as such, the complainant does not intend to prosecute the present case further and sought for disposal of the same.
The counsel for the complainant Society has also annexed the letter issued by the complainant Society wherein it is stated that the accused has paid the amount and the complainant does not intend to proceed with the present complaint.
The letter bears the seal and signature of authorized signatory of the complainant Society.
Hence, the present complaint is disposed as settled in accordance with the memo.
In lieu of disposal of the complaint, the accused is acquitted of the offence punishable under S.
138 of N I Act.
