ORDER ON ISSUE OF PROCESS The complainant has filed complaint against the accused under Sec.200 of Cr.P.C.,for the offence punishable U/Sec.
138 of N.I.Act.
The complainant and advocate for the complainant were present and complainant has filed her sworn statement by way of affidavit and relied the documents filed along with the complaint and he examined as PW1 and documents got marked as Ex.P1 to Ex.P12 The documents produced by the complainant and the averments of sworn statement placed on record, primafacie discloses that, the complainant has complied the mandatory provisions under the N.I.
Act, regarding offence under Section 138 and made out primafacie grounds in her favour for issuance of process against the accused for the alleged offence, hence, the following: O R D E R Cognizance is hereby taken for the offence punishable U/Sec.138 of N.I.Act, against the accused.
Office is hereby directed to register the case against the accused in register No.III for the offence punishable U/Sec.138 of N.I.Act.
Issues summons to the accused through RPAD, if PF and copies furnished.
