State Vs. _________________ TRF____________ Present: Learned APP for the State.
None for the accused.
Despite issuance of notice none has appeared on behalf of accused/violator.
Accordingly, this Court is of the opinion that since the accused/violator is not appearing before the Court despite repeated notices being sent to him and keeping in view the mandate of Hon'ble High Court to expeditiously dispose and to bring down the pendency of summary cases under the Motor Vehicle Act, no useful purpose would be served by keeping in challan pending only for appearance of accused/violator.
Accordingly, the proceeding in present challan is hereby stopped under Section 258 Cr.P.C. and same be consigned to the record room after needful compliance.
The record keeper is directed to not destroy the challan/Court record, as the same may be revived again on an application in the interests of justice.
