Koregaon CNR NO.-MHST0600007372023 ORDER BELOW EXH.01 Ther is an application under section 13 (3) of the registration of Birth and Death Act, 1969 for direction to the Birth and Death registration department, Registrar, (Birth and Death) Nagarpanchayat, Koregaon to register her date of birth.

Perused the application and documents filed on record.

Heard the learned counsel for the applicant.

It is the contention of the applicant that she was born on 12.08.1957 at Koregaon, Tal.

Koregaon, Dist.

Satara.

When the applicant applied for issuance of birth certificate at that time the Nagarpanchayat Koregaon in view of non-availability of record, issued non-availability certificates on 12.08.1957.

Hence, the applicant was constrained to file the instant application.

I have carefully gone through the record of the case and also gave thoughtful consideration to the submissions made by counsel for the applicant.

It appears that the applicant has placed on record non-availability certificate issued by the Nagarpanchayat Koregaon.

The applicant also filed verified copy of her Aadhar card and copy of school leaving certificate.

It is pertinent to note that in the present case the paper publication was also done in Dainik Punyanagari newspaper and no objections were received against the same.

Perusal of documents filed on record reveal that date of birth of the applicant is 12.08.1957.

Moreover, the applicant has also filed her affidavit (Exh.09)and the copy of s.c.c. transfer certificate to show that date of birth of the applicant is 12.08.1957.

From above, it is imperative to note that the evidence tendered by the applicant remained unshaken and J.M.F.C.

Thus, looking to the facts and circumstances, there is no impediment in accepting the case of the applicant that date of birth of the applicant is 12.08.1957.

In view of above discussion, I am inclined to pass following order.

ORDER The application is hereby allowed and thereby Register (Birth and Death) Nagarpanchyat, Koregaon is directed to register the date of birth of the applicant i.e.

Chaya Krishna Bodhe is 12.08.1957 in the birth register under section 13 (3) of the Registration of Births and Deaths Act, 1969 on payment of requisite fees.
