Amol Machindra Gawade .……………………………………………………………………… The present case has been filed by the prosecution under Section 4/122 of Motor Vehicle Driving Rules, 177 (a) of the Motor Vehicle Act.
2] As per the direction given by Hon’ble High Court, Bombay vide letter bearing no.
B(Gen) – 1001/2026/223 dt.
18/02/2026 today is Special Drive to dispose of the cases u/s.
279 and 281 of the B.N.S.S. (respectively under section 256 and 258 of the Cr.P.C.) 3] On perusal of record it appears that matter is old one and summary in nature.
Matter is pending for appearance of accused.
Since date of filing proceeding accused is absent.
Inspite of issuance of summons, police machinery failed to secure the presence of accused by serving the summons.
Case is pending since long.
No purpose will be served by keeping the case as it is.
4] In view of Hon’ble DLSA letter bearing No.
243/2026 dated 06.03.2026, matter has been kept in special drive campaign currently going on.
Therefore, it would be just and proper to stop the proceeding under section 258 of the Code of Criminal Procedure.
Hence, I proceed to pass the following order: ORDER 1.
The present case SCC No.1223 of 2023 is hereby stopped in view of the provision laid down section 258 of the Cr.P.C.

The accused Amol Machindra Gawade is hereby discharged from the offence punishable under section 4/122 of Motor Vehicle Driving Rules, 177 (a) of the Motor Vehicle Act vide section 258 of the Code of Criminal Procedure.

Proceeding is closed.
