ORDER BELOW EXH.1 IN S.C.C.
NO.2046/2023 State /Pandurang Perused the record.
Accused is charged for the offence punish able u/sec.130(1)/177,50/177 of Motor Vehicles Act.
Today accused is ab sent.
Summons was issued to the accused but concern police station could not serve same.
The prosecution failed to secure the presence of accused.
In the circumstances, it appears to me that, it is a fit case to exercise the option of section 258 of Code of Criminal Procedure to stop the proceeding at this stage.
Hence, there is no purpose to keep the proceeding pending as it is.
Accordingly, I pass following order.
O R D E R 1.
Accused is discharged vide section 258 of the Code of Criminal Procedure for the offence punishable under section u/sec.
130(1)/177,50/177 of Motor Vehicles Act.

The bail bond of accused stand canceled, cash security if deposited the said to be forfeited and paid it to Government (if any). sd/- ( D.
