No.172/2023 Shankar Dhande / State MHNG070016532023 ORDER BELOW EXH.
1 (Passed on this 25th day of August, 2023) 1] By this application the applicant Shankar Ajabrao Dhande is seeking interim custody of two Ox (Bull) seized by Kondhali Police in crime no.
587/2023 under section 379 of Indian Penal Code.
2] It is contended that, the seized ox are of the applicant.
If it is not handed over it will cause loss to the applicant.
Hence, prayed to allow the application.
3] The say of investigation officer and learned APP is called for.
The investigating officer filed his say at Exh.05 and the Learned A.P.P. filed say on application itself.
Both of them prayed to pass suitable order..
4] Perused the document produced by the applicant i.e. copy of Aadhar Card of applicant, copy of F.I.R. and 7/12 extract of survey no.
130.
There is no reason to believe that the Ox are not of applicant and if they are kept at Police Station under open sky, it will be creates problem for foddering them.
So far as the apprehension in the mind of learned A.P.P. is concerned, if certain condition in that regard is imposed, it will suffice the purpose.

No.123/2020 Champatrao Mahant / State 2] Police Station officer, Kondhali police station is directed to handover two white Ox to the applicant Shankar Ajabrao Dhande after executing indemnity bond of Rs.40,000/ (Rupees Forty Thousand Only).
3] I.O to prepare detail Panchnama before handing over the same to applicant.
4] Copy of this order be kept with case arising out of present crime. (Neelam J.
