Mahadula MHNG080017212023 ORDER (BELOW EXH.1) (Passed on 29.09.2023) Applicant Suhani Ramesh Tembhare has filed the present application under Section 13 (3) of the Registration of Birth and Death Act, 1969 for directing the non-applicant i.e.

Chief Officer, Nagar Panchayat Mahadula, Tah.

Kamptee, District Nagpur to take entry of her birth in the relevant record.

She submitted that her birth date is 14.12.2002, but due to lack of knowledge of law, her family members could not record the name of applicant in birth register of Nagar Panchayat Mahadula.

The applicant wants her birth certificate for official / non-official and other purposes.

Hence, she filed the present application.

The non applicant filed say at Exh.6 and stated that it did not have any objection if the entry of birth of applicant is ordered to be registered in the appropriate record.

The applicant has filed her affidavit in lieu of examination in chief (Exh.7) and reiterated the contents mentioned in the application.

She further relied upon certificate in respect of non- availability of entry of birth of herself by Nagar Panchayat Mahadula (Exh.8), verified copy of her Adhar Card (Exh.9), verified copy of her school leaving certificate (Exh.10) and verified copies of her mother’s and father’s Adhar Cards (Exh.11 and 12 respectively).

Mahadula also called for objections by issuing public notice in daily newspaper “Mahasagar” dated 11.08.2023 (Exh.13), but till date no one has filed objection to the registration of her date of birth.

Perusal of affidavit of the applicant as well as the documents relied upon by her show that the date of birth of applicant is 14.12.2002.

The evidence produced by the applicant regarding her date of birth is remained unchallenged.

Hence, the applicant is entitled to get the registration of her date of birth as per the provisions of Section 13 (3) of the Registration of Births and Deaths Act, 1969 on payment of prescribed fee.

In the result, I pass following order.

The application is allowed.

The Chief Officer, Nagar Panchayat, Mahadula, Tah.

Kamptee, Dist.

Nagpur is directed to take entry of date of birth of applicant Suhani Ramesh Tembhare i.e.

14.12.2002 as date of her birth in the relevant register through Births and Deaths Registration Officer after receiving prescribed fee from the applicant.
