Accused is absent in this proceedings since long, several times summons, non bailable warrant issued even though prosecution could not secured the presence of accused it can also be seen from the roznama.

In such circumstances there is no point in keeping the matter pending hence, I proceed to pass the following order; ::O R D E R:: 1.

The proceedings of the case is stopped under section 258 of the Code of Criminal Procedure, 1973.

Accused are discharged of the alleged offence punishable under Section 12 (A) of Gambling Act.

3.

Property seized at the time of seizure panchnama being worthless be destroyed and amount of Rs.

1,600/- be credited to the Government.

4.

The case is disposed-off accordingly.
