The case is one years old.

Matter is of summary nature.

The learned predecessor of this Court and this Court issued summons against accused, but police machinery failed to secure presence of the accused.

In these circumstances, no good purpose would be served by keeping the case pending any more.

From the charge-sheet more particular from the seizure panchanama it reveals that the investigation officer/police station officer is not seized any articles.

Hence, this Court proceed to following order; ORDER 1.

The proceeding is stopped vide section 258 of the Code of Criminal Procedure, 1973.

The accused is discharged.

Case papers be filed accordingly.
