Record goes to show that, Court has issued summons and warrant to accused on several occasions but accused remains absent.

Matter is of the year of 2023 and charge sheet is filed on 03/08/2023.

More than One year is passed away, but presence of accused is not secured by the prosecution.

Therefore, there is no any point to keep this matter pending furthermore.

Therefore, it would be just and proper to stop proceeding u/sec 258 of Cr.P.C.

Hence, I proceed to pass following order. :: O R D E R :: 1) The proceeding is hereby stopped u/sec 258 of Cr.P.C.

2) The accused is hereby released for an offence u/sec 65(e) of Maharashtra Prohibition Act which will take effect as discharge of the accused.

3) Seized Muddemal 08 bottles of 180 m.l. of Country Liquor, be sent to the Excise Department Buldana for disposal according to law after the appeal period is over.

4) This proceeding is disposed of and closed accordingly.
