5277/2023 COMMON ORDER BELOW EXH.01 (Passed on 20/10/2023) The applicants are arrayed as accused in crime no.

358/2023 registered at police station Sangvi under Sections 365, 323, 504, 506 r/w Sec.

34 of the Indian Penal Code.

They have apprehension of arrest hence they are seeking relief of pre-arrest bail by way of these applications on the grounds mentioned in the application.

The applications are opposed by the prosecution by submitting say at exhs.

06, 06 and 08.

On behalf of the informant learned advocate A.B.

Sugaonkar appeared and opposed to grant the relief claimed by the applicants.

2) Heard both the parties and perused the documents.

All the offences against the applicants, except Section 365 of the IPC, are bailable.

There is no allegation against the applicants that they used any deadly weapon during the commission of the crime.

It appears from the FIR that the FIR is outcome of friendship between one of the applicants Apolina’s daughter Ester and informant Akshay.

The applicants are native of Pune and by way of interim protection some conditions were imposed on them.

The prosecution has not come before the court with the case that any of the applicants has breached the conditions.

Some criminal antecedents of accused Kevina @ Agnel are mentioned in the say of police but that cannot be a ground to refuse relief of pre-arrest bail.

The applicants are entitled to get relief of pre-arrest bail.

In the result, following order is passed.

5277/2023 ORDER 1.

Application is allowed.

In the event of arrest of the applicants, they be released on bail subject to execution of personal bond of Rs.

15,000/- each alongwith surety in the like amount.

They shall not indulge in any criminal activity.

4.

They shall not threat the witnesses, directly or indirectly.

They shall appear before the incharge of Police Station Sangvi as and when called and shall co-operate the Investigating Officer during the interrogation.

They shall comply as per Chapter 1 Para 12 of the Criminal Manual.
