It is alleged in the petition that, the date of birth of petitioner has not been entered in the Birth and Death Register of the Respondent, due to lack of knowledge.

Inspite of service of notice, the respondent remained absent before the court and hence placed exparte.

Petitioner’ examined herself as PW.1 and got marked documents from Ex.P.1 to Ex.P.6.

Respondent not let in evidence.

Heard arguments, perused the materials on record.

The petitioner has filed this petition seeking to direct the respondent authority to enter her date of birth as 16.03.1970 in the birth register.

To prove her case she has filed her affidavit evidence as PW1 and has replicated averments of petition.

She has produced notarized copy of her pension payment order marked at Ex.P4 which shows about respondents of her parents during the year 1970.

Ex.P2 is the information furnished by ESI hospital Bangalore and as per that document on 16.03.1970 the mother of petitioner by name Devanamma w/o.

N Muthu delivered female child.

This is the mother document which corroborates the evidence of PW1.

Hence by the oral evidence of PW1 coupled with the documents at Ex.P1 to P6 the prima facie case is made out to direct the Cmis No.5058 / 2023 respondent authority for recording date of birht of petitoner in the birth register.

Hence, the petition is entitled to be allowed.

Accordingly, the following; ORDER Petition is allowed.

Respondent is directed to cause entry in the concerned register, the date of birth of the petitioner by name SEETHA LAKSHMI M.
