Misc 202/2023 L/counsel for respondent 2A and respondent 2B has filed IA No.3 U/sec 151 of CPC for release of the amount in deposit.
The petition is registered u/sec 77 of the RFCTLARR Act for disbursement of the compensation amount.
2/3 rd of the amount is been already released in favour of respondent No.1 by order dated 30.07.2024.
1/3rd of the amount is remaining.
The order dated 30.07.2024 has attained finality.
It appears that the present respondents have also agreed for the release of the said amount.
Even otherwise it is already mentioned in the earlier order that the present respondents are entitled for 1/3rd share in the deposited amount.
In that view, present application needs to be allowed.
Accordingly, IA No.3 is allowed.
The remaining 1/3rd amount shall be released in favour of respondent No.2 A and 2B.
Office is directed to release the joint account of respondent No.2 A and 2 B along with accrued interest, after complying the bank formalities.
Since the entire amount is ordered to be released in favour of the interested persons, the matter is no more survive for consideration.
Hence the petition is closed.
