ORDER 04-08-2023:- An application has been moved by the applicant through his counsel for release of vehicle mentioned above.

It has been submitted in the application that the above said vehicle has been seized by the P/S Udhampur.

The seized vehicle is still in police custody.

Applicant prayed that the above said vehicle may kindly be released in his favour.

Police report was called, which is submitted and placed on record of the file.

From perusal of the same, it transpires that vehicle has been seized in case FIR No.409/2023 u/s 279, 337 IPC.

Heard Ld Counsel for applicant and perused the application and its contents.

The vehicle is in police custody, so further custody of vehicle will not serve any purpose as its owner will be deprived of its use.

There is no impediment in release of vehicle.

Registered owner/Authorized person is directed to file an undertaking before the I.O to the effect that he is the owner of the vehicle and he shall not dispose off, change the colour or number of the vehicle till the conclusion of the trial.

He shall also undertake that he shall produce the said vehicle as and when directed to do so by the court or by the IO.

As such, I/C P/S Udhampur is directed to release the vehicle bearing registration No.

JK19-3833 in favour of the Registered owner/authorized person on supurdnama, after retaining original RC and after its mechanical check-up against proper receipt, provided the same is not required in connection with some other offence. r offence.

This application is accordingly disposed of and file shall be consigned to records after its due compilation under rules.
