The present application for implementation of order dated 17.06.2023 passed by this Court in the interim application through SHO/In-Charge P/S Bishnah has been filed by Ld.

Counsel for the plaintiff/applicant herein.

Brief facts submitted in the application are as under:- (i) That this Court had passed an interim order on 17.06.2023, wherein the defendants were temporarily restrained from causing any sort of interference in the peaceful possession of the plaintiff over the suit land.

Copy of said order is annexed with the application. (ii) It is further submitted that the order dated 17.06.2023 stands fully served on the other side and finally non applicants also caused appearance before this Court and the applicant has also filed the service affidavit as mandated by law.

The order of this court is well within the knowledge of the other side, but despite having knowledge of the order passed by this Court, the non applicants are causing interference in the suit land. (iii) It is further submitted that the non applicants are very strong headed and influential persons and are not complying the court directions and regularly causing interference in the suit land despite the restrain order passed by this Court.

Finally, it is prayed that SHO/In- Charge Bishnah, Jammu may kindly be directed to implement the order dated 17.06.2023, in the interest of justice.

Report has been called from the concerned clerk, perusal of which reveals that the defendants are duly served and they have filed written statement.

The main file is listed on 12.09.2023 for statement of parties.

Applicant has also filed affidavit in support of his application and also annexed copy of order dated 17.06.2023 passed by this Court with the application.

Counsel for the applicant has been heard and application as well as suit file has also been perused.

Non- applicants, if allowed to interfere in the suit property that would be a violation of order dated 17.06.2023 and an irreparable loss shall be caused to the applicant.

Keeping in view the above stated facts and circumstances, SHO/In-Charge P/S Bishnan, Jammu is directed to implement the Order dated 17.06.2023 passed in aforementioned suit in letter and spirit.

Office is directed to serve a copy of this order along with copy of order dated 17.06.2023 upon SHO/In-Charge P/S Bishnah, Jammu.

However, this order shall not be construed to dispossess a person in possession of the suit property.
