It is seen that the learned A.P.P. has filed one application u/s 321 Cr.P.C. for the withdrawal of the case.

Heard the learned APP and he has stated that the Government of Assam vide Notification No.

E-21705, dated 21.10.2022 has directed all the P.Ps/ Addl.

P.Ps and Assistant P.Ps to withdraw some cases from Court and following the order he wants to withdraw this case.

The learned APP has submitted that this case is no longer required to be tried against the accused.

Perused the case record which reveals that the Charge Sheet in this case is submitted by I/O u/s 341/294/323 IPC against the accused Rajesh Dey and the case is in appearance stage and offence is not explained to accused till now.

As the government wants to withdraw the case and APP has filed a petition u/s 321 Cr.P.C., the petition is allowed.

The case is accordingly disposed of on withdrawal by learned APP.

The accused Rajesh Dey is discharged from this case.
