5133/ 2023 COMPLAINANT : THE STATE OF GUJARAT V/S ACCUSED : REKHABEN VINODBHAI VANKAR ----------------------------- ORDER BELOW Ex.1 (JUDGEMENT U/ S 241 OF THE CODE OF CRIMINAL PROCEDURE, 1973) --------------------------------------------------- 1) The charge-sheet against the accused of this matter was filed before this court by investigating officer of this case.
It is alleged that the accused has committed an offence u/s 65AA of The Gujarat Prohibition Act.
2) The accused appeared today before this court.
He/They plead guilty for offence against him.
Their/his plea is/are recorded vide Exh.

3) The offence alleged against the accused provides punishment extend to 3 years and fine.
The accused submitted that, he is assuring that he will not commit likewise offence in future & prayed to this court to award him less punishment as they are poor.
Taking into consideration the ratio provided in STATE OF GUJARAT VS NATWAR HARCHANDJI THAKOR, 2005 0 CrLJ 2957, the poverty and circumstances of this case, this court thought it proper to give minimum sentence while convicting him.
Therefore, passing below final order : -::ORDER::- The accused of this matter is/are hereby convicted u/s 241 of The Code of Criminal Procedure, 1973, for offence offences u/s 65AA of The Gujarat Prohibition Act, 1949. The accused shall undergo imprisonment till the rise of this court or before that, if this court directs and pay Rs.
50=00 (Fifty) each as fine. On failure to paying fine each accused shall undergo simple imprisonment of Day 01. The seized muddamal to be destroyed or forfeited as prescribed under law and rules, after the lapse of period for appeal. The matter is thereby disposed of accordingly.
