Before proceedings further it was brought to the notice of the Commission that sole legal heir who was earlier impleaded as legal heir of his father Shri Raj Kumar original complainant, has also died due to covid.
His widow Smt.
Renu Goyal has moved an application for impleading herself alongwith her minor children being legal heirs of Harsh Goyal.
Alongwith this application death certificate of Harsh Goyal was also submitted and power of attorney executed by applicant has also been placed on record by Shri Parvesh Khera Advocate.
This development was not objected by learned counsel for the OPs Shri Mohit Verma, Advocate.
In view of this development, Smt.
Renu Goyal alongwith her minor children are impleaded as legal heirs of Harsh Goyal.
During further proceedings present legal heirs brought it to the notice of the Commission that on account of successive deaths in her family and on account of object poverty they are not in a position to clear the arrears as demanded by the OPs.
Therefore a request to permit them to deposit the outstanding amount i.e.
Rs.24728/- by way of instalments was made.
This development was brought to the notice of Mr.
Mohit Verma Advocate who after getting in touch with concerned department authorities acceded the proposal.
However being sympathetic to the whole situation present legal heirs of the complainant are permitted to deposit outstanding amount by way of instalments Rs.5000/- every fortnightly. rtnightly.
It is also made clear to the present legal heirs of the complainant that in case there will be any default in this regard then of course they will forfeit the right of this concession and then the OPs will be well in their right to demand the remaining amount in one go.
Needless to say over and above the above said instalment of Rs.5000/- the present LRs will also bear the current energy charges whenever being issued to them bi-monthly.
Both the parties got recorded their separate statements and as LRs of original complainant do not wish to continue so in view of this the present complaint is disposed of accordingly.
Needless to say both the parties shall be bound by their statements.File be consigned to records in due course. [HON'BLE MR.
