I.A No.06 of 2020 was filed by the respondent no.1 stating that Title Suit No.16 of 2015, filed by the petitioner, was dismissed by the learned District Judge, Special Division-I, Gangtok by Judgment dated 27.03.2018.
He submits that challenge in the Writ Petition was, amongst others, to an order releasing land acquisition compensation amount to the respondent no.1, and the claim made by the petitioner in Title Suit No.16 of 2015 that the land acquired was part of the ancestral property having been negated, nothing survives for consideration and the Writ Petition has been rendered infructuous.
Mr.
Sherpa also submits that in view of the developments as indicated in the I.A No.06 of 2020, the Writ Petition has been rendered infructous.
In view of the submissions made by the learned Counsel for the parties, the Writ Petition is dismissed as infructuous.
I.A is also disposed of.
