JUSTICE ARUP KUMAR GOSWAMI, CHIEF JUSTICE … On the last occasion,when the matter was listed on 01.10.2020, the Court had passed the following order:- “An I.A being No.02/2020 was filed seeking withdrawal of the Writ Petition.

Subba, learned Counsel, who is representing the petitioner, however, submits that the application was not filed by him.
Also heard Mr.
Vivek Kohli, learned Advocate General, Sikkim appearing for the respondents.
In view of the submission of Mr.
Subba, I direct Registry to list the case on 06.10.2020 so that, in the meantime, he may try to obtain instructions from the petitioner.
Interim order shall continue till next date.” Mr.Y.K.Subba, learned Counsel submits that the petitioner has informed him that he himself had filed I.A No.02/2020.
He reiterates that the application was filed without his knowledge and the petitioner had not withdrawn the Vakalatnama.

Since it is not in dispute that the petitioner himself had filed the application seeking leave of the court to withdraw the writ petition, the Writ Petition is dismissed on withdrawal.
IA No.02/2020 stands disposed of in terms of the above.
