It is submitted by learned Public Prosecutor that Order dated 30.8.2016 in S.T. (POCSO) Case No.

01 of 2016 (State versus Hangit Rai @ Raj Rai) reads, inter alia, as follows; Therefore, the prosecution is directed to take necessary steps to bifurcate and split the case paper/chargesheet against the accused No.

2 and let the order of this Court along with the case papers/charge-sheet against the accused No.

2 Hangjit Rai@ Raj be forwarded to the Hon'ble i-iigh Court of Sikkim for necessary direction/order as deem fit and proper to try the case against the accused No, 2 Hangit Rai @ Raj having appropriate jurisdiction.

1 That, in compliance to the above said Order, the Prosecution has bifurcated the trial against the Accused Subash Chandra Rai and Accused Hangjit Rai @ Raj Rai, pursuant to which a copy of the Charge Sheet has been forwarded to this Court.

That, it appears that there is no FIR > SGPG- 4/Comp.4/High Court/ 5000 Nos./14,03.2014 Case No.

Date Order (s) with Signature (s) 1 against the Accused Hangjit Rai @ Raj Ral and, therefore, the Prosecution be allowed to take necessary steps in this regard.

Accordingly, the Prosecution may take necessary steps as prayed for by the learned Public Prosecutor.
